Terms of Sale
1. Who we are and what this covers
These terms apply to every order placed on buyingdesigner.com. Buying Designer is the name under which Matteo Parmeggiani, a private individual, offers design work. The seller is Matteo Parmeggiani, private individual, Via Fratelli Cervi, 14, 40129 Bologna BO, Italy. Email: support@buyingdesigner.com. Phone: +39 0439 342 9066. The same details are on the Imprint page.
2. Definitions
- We, us: the seller named above.
- You: the person or business placing the order.
- Private customer: a person buying for purposes outside their trade, business or profession.
- Business customer: anyone else.
- Package: a fixed-price design service listed on the Packages pages.
- Deliverables: the final files listed in the package description.
- Round: see section 7.
- Concept: a distinct design direction we present to you.
3. Orders
Orders are placed through the order page. Paying on Stripe’s page places a binding order. The contract is concluded when your payment is confirmed, and we confirm by email. We may refuse an order before we confirm it, and if we do, we refund anything you paid. You must give us accurate details.
Italian businesses can’t pay online. If you are a business based in Italy, write to us through the contact page. We’ll send a ricevuta showing the ritenuta d’acconto (withholding tax) and our bank details, and the contract is concluded when we both confirm the order in writing.
4. Prices
Prices are in euro. Prices are final. As a private individual providing occasional services, we don’t charge VAT. The amount shown on the order page is the amount you pay.
5. Payment
You pay by card through Stripe. We don’t see or store your card number.
- Packages under €1,500 are paid in full at checkout.
- Packages from €1,500 are paid 50% at checkout. We email a Stripe payment link for the balance when we deliver. The balance is due before we release the final files and the rights transfer to you.
- Stripe sends a payment receipt; we send a ricevuta for each payment.
- Italian businesses pay by bank transfer against our ricevuta (see section 3).
6. Delivery and timelines
Each package page gives an estimated timeline. Timelines are estimates, counted from when we have your brief and answers, and the clock stops while we wait for you. Deliverables are delivered by download link or email. If you consider a delivery doesn’t match the package description, tell us in writing within 14 days and we’ll fix it.
7. Revisions
A round is one consolidated list of changes sent together on the concept you chose. A new direction is a concept, not a round. Included concepts and rounds are listed on each package page. An extra concept costs €290 and an extra round costs €150, and both are agreed before we start. If we’ve waited 14 days for your feedback, the project is paused. If we’ve heard nothing for 60 days, we may close the project and keep the payments for the work done.
8. If you don’t like the concepts
Brand Identity, Brand System and the Brand + Website bundle include one fresh concept round if none of the first concepts work for you. Logo doesn’t; an extra concept is €290. If you choose to stop after the first concepts, you pay 50% of the package price, no final files are released, and we keep the concepts.
Private customers: this section doesn’t limit the withdrawal term in section 12. Any payment for work already done after a withdrawal is worked out on the proportional basis described there.
9. Your responsibilities
You give us the briefs, content and feedback we need, and you confirm you have the rights to anything you supply (text, images, logos). Business customers: you indemnify us against third-party claims relating to material you supply. For web packages, you supply the copy; copywriting isn’t included.
10. Ownership and licences
When you’ve paid in full, we assign you in writing the economic rights in the final delivered files. Concepts you didn’t choose stay with us. The moral right to be named as author can’t be assigned; we won’t insist on a credit unless you ask us to. Third-party fonts, images and other materials have their own licences. We list them in the handover, and you obtain any licence they require. We may show the finished project in our portfolio unless you tick the opt-out on the order page, which is free. We check for obvious conflicts in a quick search but do not carry out a legal trademark clearance, and we can’t promise a mark is registrable or free of conflicts. To register a mark, talk to a trademark attorney or UIBM/EUIPO.
11. AI use
We may use AI tools for research, ideation or production support. Final deliverables are reviewed and finished by a human designer. We do not upload your confidential materials to public AI tools without your permission. Elements generated with AI may have weaker copyright protection, so tell us if you need fully human-authored work.
12. Right of withdrawal for private customers
If you buy as a private customer, we give you 14 days from the conclusion of the contract to withdraw without giving a reason. This is a term of our contract, and we offer it to every private customer. If you’ve asked us to start work within that period, you pay a proportional amount for the work already done, and the right ends once the service has been fully performed. Full details and the online withdrawal form: Withdraw from a contract. Business customers don’t have this right; section 13 applies to them.
13. Cancellation by business customers
You can cancel before kickoff by writing to us; we refund what you paid less a fixed cancellation fee of €150. After kickoff, the deposit or amount paid is non-refundable. Where work was agreed in full and not yet delivered, the balance remains payable.
14. Build option
Where you choose design and build, we build the approved design as a static site. Hosting and domain names aren’t included. We charge no recurring fee. Maintenance after delivery isn’t included. A CMS or shop is not part of the package and is quoted separately.
15. Warranty
If a deliverable doesn’t match the package description, we fix or redo it at no extra charge, provided you tell us in writing within 14 days of delivery. This is our commitment under the contract. It doesn’t remove any right you have under rules that can’t be excluded by contract.
16. Liability
Nothing here limits our liability for wilful misconduct, gross negligence, or anything the law doesn’t allow us to limit. Subject to that, for business customers our total liability for any claim is limited to the amount you paid for the package. We aren’t responsible for third-party licences, hosting, or decisions you make based on our work, such as registering a trademark.
17. Confidentiality
We treat the non-public information you share with us as confidential and use it only for your project, unless the law requires otherwise.
18. Complaints and dispute resolution
Write to support@buyingdesigner.com with the details. We’ll reply, usually within two working days. We haven’t committed to a specific alternative dispute resolution body. That doesn’t affect your right to use one if one is available to you, or to go to court. The EU online dispute platform closed in July 2025, so we don’t link to it.
19. Law and courts
Italian law applies. For business customers, the courts of Bologna have jurisdiction, unless mandatory law says otherwise. Private customers keep the protection of any mandatory rules of the country where they live, and can bring a claim in the courts of that country.
20. Changes
We may update these terms for future orders. The version that applies to you is the one shown when you placed your order, which we log with your order.
